Picture isn't very clear. What do the leaves look like? I apologize if that is what the second picture is. Its not loading on my phone.

yes the second picture is a close up of the leaves. But they are flat, medium sized leaves and some turned red. The tree also has acorn shaped seeds on it, I don't know if there seeds are flowers I haven't seen any yet. I was hoping it was just a bush that hadn't been pruned .Lol

Looks like a shrub, possibly a Rhododendron. Its not an oak, judging by those leaf arrangements.

Does it get little white flowers on it? Or any flowers at all? It looks like a sweet olive to me.

It would be seasonal. Do a Google image search and compare

It definitely looks like a sweet olive. If it is a sweet olive is there a way to keep the roots from damaging my slab, pruning etc.?

Dig it up and plant something else. It's too close to your house anyways.

If you can get enough root out with it, you could probably save it. Gonna need a big bed or plant out in the yard somewhere.

Tree?
Deffinatly a jap blueberry , plant is to close to home. I wouldn't bother transplanting it. I'm a landscape designer by trade.
