Default Property line laws.

I know how to find out tomorrow this info but I was wanting to find out today and also have written prove not just words. I'm needing to find the laws on how close a structure can to a property line. I was told when I was looking at getting a shop put on my property that it had to be at least 5' from the property line. Any help would be appreciated.

I know when I built my shop it was 5 feet.

But a driveway can be right on the property line. Never understood that.

But learned that when my neighbor poured his driveway.

5' is what I've heard. I wonder what can be done about something that's already been built but could be moved that's on against the property line.

if a building permit was needed to build the structure that is on the line a lot can be done. If not more than likely civil court .

In Lake Charles, it is 5 feet from the property line. If it needs to be closer than that, you have to apply for a variance. The city holds a public hearing to rule on variance requests, and the next meeting is August 13th. If nobody disputes the structure, it will probably be approved. If the adjacent landowner disputes it, then it will likely be refused (or ordered to be moved if it is already built).

I'm goin thru this right now with my new house. I have 150' of 8' tall brick wall/fence around the front of my house and partially up 1 side . All of it is on the property line . I had to write letters and include a site plan to all utility companies that may have utilities in servitude in question .

Should be set up for that subdivision, if you have an abstract it will be in there. My new lot is structure mug be 10' from line and drive can be on line but every subdivision has its rules

you would have to get with the permit office to see what the setbacks and riteways are on that property. you should have been given that info when you bought the property, if you still have that paperwork. then you have to deal with the building codes IRC 2009 book. the rule of thumb is 5' from lot line or any other structor on the property.if you do go closer than 5', then that wall must be constructed as a 1 hour fire wall protected from the outside. meaning from 3'-5' you must put fire rated sheetrock on the exterior under your finish material, and you are limited on doors and windows on that wall. if it falls from 0'-3' from the line you have to have a 1 hour fire wall and no openings in that wall. it also counts for projections (over hangs/ soffits). they too must be wrapped in sheetrock or an approved fire rated materials. as far as building codes the law is state wide since jan , 2007. good luck!! contact David Thibadaux with calc. parish. he's also on the stae board.

Each Parish has it's own regs and if your in a subdivision there is probably more restriction to abide by. Good Luck with da neighbor.

Have the parish make them move it. Once 1 person does it, it becomes easier for the next person to do the same. That's why people buy and build in subdivisions, so their neighbor can't do something like that. You may not really care but when it becomes time to sell your house, prospective buyers might not like it and that translates into fewer buyers considering your house.

Thats the other twist to this whole mess is they are selling their house. I would rather make the neighbors we have now mad rather than the new neighbors.
