Good read. I would be interested in seeing how this would have played out in higher level courts as natural law pervaded the Constitution but was explicitly expressed in the Declaration of Independence-

"When in the Course of human events it becomes necessary for one people to dissolve the political bands which have connected them with another, and to assume among the Powers of the earth, the separate and equal station to which the Laws of Nature and of Nature's God entitle them, a decent respect to the Opinions of mankind requires that they should declare the causes which impel them to the separation.

I was thinking about this exact topic the other day. I can understand having a reasonable limit on game, but to require us to buy a license to use OUR natural resources is ridiculous. The gov't did create the marsh that we take ducks from, or the woods we take deer from, or the waters we catch fish from...... Why in the Hell should we be required to pay them to do it? The same can be said for registering boats. I don't remember the chapter in American history where the gov't dug the Mississippi river or the bay.
