OFFICIAL RULES
Geaux Fish Tournament NO PURCHASE NECESSARY TO ENTER OR WIN. YOU HAVE NOT WON. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. CONTEST OVERVIEW: Geaux Fish Tournament (the "Contest") begins on July 2, 2011 and ends September 5, 2011 at 11:59 p.m. Eastern Time ("ET") (the "Contest Period"). The Contest provides anglers the opportunity to catch a tagged fish that can be worth up to $250,000 or other prizes, as described below. By participating in the Contest, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Louisiana Charter Boat Association, 13824 Red River Ave., Baton Rouge, LA 70818 ("LCBA") and BP Exploration & Production Inc., 501 Westlake Park Blvd., WL1-21.160, Houston, TX 77079 ("BP" and collectively, with LCBA, "Sponsor"), which shall be final and binding in all respects. ELIGIBILITY: The Contest is open only to legal U.S. residents who are eighteen (18) years of age or older. Contest is void where prohibited by law. Employees, officers and directors of LCBA, SCA Promotions, Inc. ("SCA"), The Ehrhardt Group, and each of their respective parents, subsidiaries, affiliates, distributors, retailers, sales representatives, advertising and promotion agencies, and Louisiana Game & Fish representatives directly involved with the Contest (collectively, the "Contest Entities"), and their immediate family members and/or those living in the same household of each are ineligible to enter the Contest or win a prize. Current employees of BP are ineligible to enter the Contest or win a prize, however family members of current BP employees and former retired BP employees are eligible to participate. Only individuals may participate. Contest is not open to commercial charter boat captains or crewman, however paying charter customers/individuals on those boats are eligible to participate. HOW IT WORKS:To participate, visit the website at www.geauxfish2011.com (the "Website") during the Contest Period, and complete the participation form with the information requested. Eligible anglers do not have to register prior to catching a tagged fish. Prior to the start of the Contest Period, representatives of SCA will prepare a minimum of fifty (50) tags with unique numbers. SCA will then randomly pre-select one (1) of the unique numbers as the "Grand Prize Winning Number." The remaining forty-nine (49) tag numbers will be randomly assigned to other prizes as described below. Then representatives of Sponsor and/or SCA and/or Louisiana Game & Fish will randomly and evenly tag and release a minimum of fifty (50) fish each tagged with one of the unique numbers throughout the "Eligible Waters" (as defined below). If a registered participant catches a tagged fish during the Contest Period, he/she must go to the Website and log-in using the username and password created at registration (if he/she has already registered for the Contest) or follow the on-screen instructions to register for the Contest. Once an eligible angler has logged in or registered at the Website, he/she must then follow the on-screen instructions to register the tagged fish. Any tagged fish caught must be registered on the Website within twenty-four (24) hours of the catch. Administrator will then compare the tag number entered to the Grand Prize Winning Number and if the tag number matches the Grand Prize Winning Number exactly and in order, that entrant wins the Grand Prize, subject to the conditions noted below and verification of eligibility. If the tag number does not match the Grand Prize Winning Number, the Sponsor will determine the prize associated with the tag number entered. The time and date of registration on the Website will determine the order in which a fish has been caught and presented for purposes of the Contest. Sponsor and/or Administrator will contact any potential winner after verifying a tag number, with details regarding the prize won and to provide instructions to confirm eligibility and to claim the prize. Potential winners must provide Sponsor and/or Administrator with the actual tag and may be required to provide a photograph of the participant with the tagged fish at the time of the catch. The following conditions must be met in order to be considered for the Grand Prize:
Bonus Prize: If an eligible angler catches the fish tagged with the Grand Prize Winning Number and the fish is caught and registered on the Website as the first through tenth fish, AND the eligible angler is a paid charter fishing with a licensed Louisiana Charter Boat guide at the time of the catch, 10% will be added to the amount won by the eligible angler. In the event that at the conclusion of the Contest Period no tagged fish are caught and presented, Sponsor will randomly select one (1) of the registered participants who will have the opportunity to win $10,000 ("Consolation Winner"). The Consolation Winner will then have the opportunity to randomly select one (1) of fifty (50) unique numbers. If the randomly selected unique number corresponds to the Grand Prize Winning Number, the Consolation Winner will receive $10,000, subject to verification of eligibility. No prizes will be awarded to any participant presenting a tagged fish that has been caught other than during the Contest Period. All tagged fish must be caught in accordance with all federal, state and local laws, codes, rules and regulations and must be caught in the manner prescribed by the International Game Fish Association ("IGFA") international angling rules. A copy of the IGFA rules are available at http://igfa.org/Fish/INTERNATIONAL-ANGLING-RULES.aspx. Sponsor will have no obligation to award any prize to any participant who does not comply with these Official Rules or any federal, state and local laws, codes, rules and regulations and the IGFA rules. All fish must be caught in "Eligible Waters." Eligible Waters shall consist of waters in South Louisiana as specified on the Website in which the public has free and unlimited access. All Louisiana state waters south of I-10 that are publicly accessible between Breton Sound and Lake Calcasieu are eligible. Fish caught in illegal "off limit" waters or sanctuaries are not eligible for prize consideration. Eligible Species of Saltwater Fish:
PRIZES/APPROXIMATE RETAIL VALUES: In addition to the Grand Prize, the following prizes are available: One (1) 2011 Ford F150 4x2 Supercab Truck with a 145" wheelbase, 3.7L V6 FFV Engine, Elecronic 6-speed automatic transmission with the preferred equipment package 503A. With an MSRP of $30,680. The MSRP is subject to price fluctuations in the consumer marketplace based on, among other things, any gap in time between the date the MSRP is estimated for purposes of these Official Rules and the date the prize is awarded or redeemed. Sponsor will contact winner directly once he/she is verified to coordinate delivery of the vehicle. Vehicle will be delivered with standard equipment for make and model; all upgrades and options, are at the sole cost of winner. Winner may not have choice of color. Title, taxes, registration, license, and similar fees, and insurance costs are the sole responsibility of the winner. Winner must possess a valid U.S. driver's license. Winner will be required to show proof of currently valid driver's license and insurance prior to taking delivery of the vehicle. Prize will be delivered to a dealer near winner's residence (as determined by Sponsor) and if winner does not personally pick up prize within thirty (30) days of delivery notice prize will be forfeited and may be awarded to an alternate winner. Transportation to/from dealer is the sole responsibility of the winner. Sponsor shall not be responsible for delays in delivery of the prize vehicle, and delivery is subject to availability. Sponsor, however, shall use all reasonable efforts, subject to availability, to deliver the prize vehicle within one-hundred twenty (120) days of completion of the verification process. The winner shall bear all risk of loss or damage to the prize vehicle after it has been delivered to the specified delivery site. Vehicle will be delivered solely with the express limited warranties set forth in the vehicle's Owner's Guide, which warranties shall run for the term set forth in said Owner's Guide. One (1) 2011 Blazer Bay 2170 Center Console Bay Boat with Suzuki 175 HP EFI 4-Stroke electric with PT & T. Boat comes with white hull with deluxe leaning post with ice chest cooler, dual axle aluminum trailer, 24-volt Minn Kota troll motor with a hard 80 LB thrust and 52" shaft; 2-Deep cycle batteries with trays, charger, plug, outlet; and Garmin GPS 541s color. Five (5) Sporting Goods Prize Packages with an approximate retail value ("ARV") of $1,000 ea. Thirty (30) $500 gift certificates to a Sponsor designated outdoor or sporting good retailer. Nine (9) prizes of $500 cash each. GENERAL PRIZE CONDITIONS: No cash alternative or prize substitutions will be allowed, except Sponsor reserves the right to substitute prize(s) of comparable value if a prize listed is unavailable for any reason. Prize winners shall be solely responsible for all federal, state and/or local taxes, and the reporting consequences thereof, and for any other fees or costs associated with the applicable prize. Any potential prize winner must execute an Affidavit of Eligibility, a Liability Release, and (where imposing such condition is legal) a Publicity Release (collectively, "Prize Claim Documents"). If winner fails or refuses to sign and return all Prize Claim Documents within ten (10) days of prize notification (or a shorter time if required by exigencies), winner may be disqualified. Additionally, any Grand Prize Winner must, at Sponsor's sole expense, submit to and pass in a conclusive manner, a polygraph examination as a condition precedent to receiving any Grand Prize. Required parties must sign a normal and customary waiver as required by the polygraph examiner and Sponsor must present the conclusive results of the polygraph examination to SCA no later than thirty (30) days after the conclusion of the Contest Period. GENERAL LIABILITY RELEASE: By participating in the Contest, each entrant agrees that the Contest Entities and BP (i) shall not be responsible or liable for any losses, damages or injuries of any kind resulting from participation in the Contest or in any Contest related activity, or from entrant's acceptance, receipt, possession and/or use or misuse of any prize, and (ii) have not made any warranty, representation or guarantee express or implied, in fact or in law, with respect to any prize and specifically disclaim all such warranties, including without limitation, the implied warranties of merchantability and fitness for a particular purpose. Prizes will only be awarded to a verified winner. The Contest Entities and BP assume no responsibility for any damage to an entrant's or any other person's computer system which is occasioned by accessing the Website or otherwise participating in the Contest, or for any computer system, phone line, hardware, software or program malfunctions or other errors, failures, delayed computer transmissions or network connections that are human or technical in nature. Without limiting the generality of the foregoing, Sponsor is not responsible for incomplete, illegible, misdirected, misprinted, late, lost, damaged, stolen, or (if applicable) postage-due submissions or prize notifications; or for lost, interrupted, inaccessible or unavailable networks, servers, satellites, Internet Service Providers, web sites, or other connections; or for miscommunications, failed, jumbled, scrambled, delayed, or misdirected computer, telephone or cable transmissions; or for any technical malfunctions, failures, or difficulties, printing errors, clerical, typographical or other error in the offering or announcement of the prize or in any prize notification documents, or other errors of any kind or nature; or for the incorrect or inaccurate capture of information, or the failure to capture any information. If, for any reason, the Contest is not capable of running as planned, including, due to infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, Sponsor reserves the right in its sole discretion to cancel, terminate, modify, suspend or extend the Contest Any attempt by an entrant or any other individual to deliberately damage the Website or undermine the legitimate operation of the Contest, or to annoy, abuse, threaten or harass any other person in connection with the Contest, is in violation of criminal and civil laws and should such an attempt be made, Sponsor reserves the right to disqualify the applicable individual and seek damages and other remedies from any such person to the fullest extent permitted by law. If any provisions of these Official Rules are determined to be invalid or unenforceable, these Rules shall otherwise remain in effect and shall be construed in accordance with their terms as if the invalid or unenforceable provision were not contained herein. GOVERNING LAW/JURISDICTION: ALL ISSUES AND QUESTIONS CONCERNING THE CONSTRUCTION, VALIDITY, INTERPRETATION AND ENFORCEABILITY OF THESE OFFICIAL RULES OR THE RIGHTS AND OBLIGATIONS OF ENTRANTS OR SPONSOR IN CONNECTION WITH THE CONTEST SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE INTERNAL LAWS OF THE STATE OF LOUISIANA WITHOUT GIVING EFFECT TO ANY CHOICE OF LAW OF CONFLICT OF LAW RULES OR PROVISIONS THAT WOULD CAUSE THE APPLICATION OF ANY OTHER STATE'S LAWS. WINNERS LIST: To obtain a copy of any legally-required winners list, send a self-addressed stamped envelope to: Geaux Fish Tournament Winner, 3030 Lyndon B. Johnson Freeway, Suite 300, Dallas, TX 75234. All such requests must be received within six (6) weeks after the end of the Contest Period. Winner's name (if any) will also be posted on the Website.
