Nothing wrong, he caught it and had to remove the hook, didn't you do the same to a loon (protected under Migratory Bird Treaty Act) you caught? No harassment, just an accident is all

Bout like catching a red snapper on accident out of season and taking pictures of it and releasing it

The lady was probably disturbing a nesting sea turtle

You have no clue about the severe penalties of Sea Turtle until you work offshore
http://www.fws.gov/archiecarr/laws.html
The lady was with a guide and she saw it swimming ..she asked the guide for the WLF #... They put in net and called WLF

They were located in turners ... The WLF told her to release the turtle and set anchor and do not move until Enforcement shows up.. She was given a citation for removing endangered species and almost was arrested .. This was last month on big lake. The guide had to bring her back into dock ASAP

They don't play with Sea Turtles

The story of a lady that catches one in net can be considered harassment, catching one on accident and then removing the hook is totally different.

Loons and red snapper are NOT protected under the Endangered Species Act, but loons are protected under the Migratory Bird Treaty Act, as are seagulls, robins, great blue herons, red-tailed hawks, etc. If you intentionally harass one, you will be fined.

Same with bluefin tuna, if you try to catch one on purpose you will be fined, if you hook one on accident, then its a different story.

Well let's see what federal agent would say? So you caught a endangered species and removed it from water ? But you took time to take a picture instead of getting back to water quickly
Here is your citation see u in federal court and you explain why you have a pic of a endanger species on the internet posing for pics

No Jr Game warden just stating facts ,we have to review sea turtle laws often offshore , we had turtle watchers at our platform for 3months while we were trying to remove an PNA Platform and they shut them down about 18 times due to sea turtle with in 25 miles

I just followed your link. I can't find anywhere that says if you hook an endangered sea turtle by accident using rod and reel that it is illegal to unhook and release it.

What are you supposed to do if you hook one by accident?

They are pretty cool. I've never seen one in big lake. But I have seen them at the jettison and I've seen some bulls offshore.

What I would do...take hook out while in water and never have a trace or evidence I even saw one!
I'm telling you the Federal wardens would eat this post alive !

The guide who had the Lady in boat said if he ever sees a turtle and if he is catching 5lb trout he is leaving. That's how bad of a deal it was , not local but federal wardens ! He told us if you see a turtle run! Because you don't want to even be close to one to maybe have someone see you close to one!

And if a turtle watcher girl can shut down a multi million dollar project because she saw a sea turtle with in 25 miles of platform .... They take it for real

http://www.fpir.noaa.gov/PRD/prd_fis...a_turtles.html

If you choose to help and it is safe for you and the turtle:
REEL-IN turtle with care. Please bring in the animal for disentanglement. Do the best you can to reel-in (land) the animal carefully. DO NOT drag a turtle up a cliff.
HOLD turtle by its shell and/or flippers.
CUT line close to hook as short as possible .
REMOVE the hook only if it can be done without injury to you or the turtle. If the hook barb is exposed smash the barb down to easily extract the hook and shorten the handling time of the turtle. DO NOT remove the hook if swallowed. If using a barbless hook, then the hook should easily come out.
RELEASE turtle with no line attached. Remove any line from flippers, head and neck. Help to remove any remaining line from the reef. Dispose of the line in a responsible manner.

FYI!

How bout just say, nice photo but you may want to be careful next time as these are endangered species

many mussels that people dig up when they are playing around in the river or the shells of them we find on the bank are endangered species,

and technically you are not supposed to keep any feathers from birds protected under the MBTA, how many people have hawk feathers in their cowboy hats?

Is that what you did with that loon Same thing 'W', they are all federally protected. You did the EXACT same thing to a federally protected animal, and even took video of it. Were you ever worried? You shouldn't be, because you did the right thing, no big deal.

I am not sure, but I would bet whale sharks are protected from harassment but if I run across one in the gulf I am jumping in and swimming with it
