The "stand your ground" states (TX & LA) say you can stand your ground, you don't have to run away You can stay on your front porch and drop the scum

Louisiana allows the use of deadly force to prevent a car-jacking.

So you see, it all depends on the state. In general, though, you cannot use deadly force unless you feel you life is in danger. Or somebody else's life. Breaking in does not meet this requirement, not unless there is a reasonable danger to life.

A cautionary word: Never, never, never fire a warning shot into the air. A slick prosecutor will ask "If you felt your life was in immediate peril, why were you shooting into the air"?

I do know that on one of the other break-ins the shooter had his prescription of aderal(sp) stolen. These guys probably thought it was an easy score on some pills and decided to try again. Don't think those catholic school kids aren't like that, cause where you think the public school kids used to buy their drugs from! From the story I heard Seth heard the people in his truck and walked outside to see. Saw them and went get his gun when the driver drove around to pick up the two breaking in, he went after them. Like I said, it's what I heard so take it with a grain of salt. It sounds a lot more probable than kids looking to score a few suds, or some random crazy person standing in the road at 2 in the morning shooting at random vehicles.

You shoot, be prepared to defend yourself until your not proven at fault....a gun is used in the last OPTION if needed and your lifes on the line...not to just shoot people to warn them, i live guns and guns dont kill people, people kill other people jmo...good luck shooting someone with no questions asked...

I'd love to believe tht but that is a statement from a blind dad who isn't paying attention to what his kid is really doing. You think for one second that dude shot 3 times and hit 3 kids when they were just slowing down to drop a boy off. I don't believe that for a second. That's what his son told him and of course his kid "does no wrong". Gimme a break

I will say that I have to agree. I will not speculate on what happened that night, because as many have said, we will not know until all the details come out. But this guy is blinded by his kid being hurt. I just can't believe that this guy managed to hit 3 kids, killing 1, with a handgun when they were in a moving vehicle.

But I guess crazier things have happened. Only time will tell. But i would definitely say the father is blinded, because he was not in the vehicle or on that street when all this happened.

And on the note of the 1st degree murder charge--correct me if I'm wrong, but 1st degree is premeditated, right? So this guy had the intention of killing someone on his street at 2 AM?

W a car jacking is one thing............you are IN THE CAR and someone comes to TAKE THE CAR........

No little big man, if you walk out and have a gun and said thieve is un armed HE feels threatened.........
