Default Louisiana cell phone law

I received this information today and thought I would share it with all of you!

[SIZE=3]FYI: This law is going to be strictly enforced. Please remember if you happen to be involved in an accident, whether it is your fault or not, and it is determined you were on your hand held cell phone or texting (which can easily be determined) at the time of the accident, the insurance company will deny payment to you.[/SIZE]

Primary offense. Fines of $175 plus court costs, and then $500 for any other offense. Primary enforcement (primary enforcement status means law officers could stop and cite violators solely for that offense)will begin Sunday, Aug 15, 2010. Please tell all drivers and employees who may be traveling in or thru the State of Louisiana of this new law[/SIZE]

There's no way an insurance company can deny payment on a claim cuz you were on the phone. The ban applies to texting only anyway. I'll make cell phone calls where ever I please.

Besides, I don't think we need more laws, there are already laws that can punish you for distracted driving.

LA Senate Bill 863 pertains to Millenium Port which was passed in 1999.

Legislation that would have outlawed handheld cell phone use by all drivers again failed in the House in 2010.

Current prohibitions:
  • Text messaging banned for all drivers. Fines up to $175 (first offense) and then $500. Primary enforcement begins Aug. 15, 2010.
  • Drivers under 18 years old may not use wireless devices — including cell phones, text-messaging units and computers — while operating motor vehicles. Primary offense as of Aug. 15.
  • Drivers with learner’s and intermediate licenses prohibited from using cell phones unless a hands-free device is attached.
2010 legislation:
Louisiana Senate Bill 9: Upgrades the existing law prohibiting text messaging to primary enforcement status, meaning law officers can stop and cite violators solely for that offense. To some degree I agree with you, but it's a slippery slope. No cell phones leads to no GPS units, no iPods, no radios, no manual transmissions, then the law states that you must drive with 10 & 2 hand positions, etc. When does it end?

Of course, someone who came up in the days of horse-drawn buggies would feel this way!

Really, the texting crap needs to end. While good for my business sometimes, more times than not, the extent of damage from the accidents are beyond repair...And so are the people! I can't fix people or their families!

I don't need the business that bad.

They can't exclude paying for dwi damage. Legal is as legal does, no way to change contracts or exclude something that has not happened.

This ain't New York. We still have the freedom to talk on the phone. I do it sometimes, but I prefer to pull over and talk. It really is safer. Texting while driving is just plain stupid.

I saw a young girl driving on the interstate the other day holding up traffic and had both arms through her steering wheel texting. Not one hand on the wheel but had her arms through it. I wanted to blow the horn and show her she is #1.

reading newspaper

eating

sex

looking at pron magazines


I used to drive a truck for a living.

The new phones coming out have voice text, so this will not be an issue soon.

i read this is daily advertiser...

but if your older than 18, it doesn't apply to you unless you are texting. Nobody can text and drive. But if your older than 18 then you can make phone calls. Thats the way i took it when i read it in the newspaper.
