Default Louisiana Senate Bill 303

Section 11 states: The right of each citizen to keep and bear arms is funamental and shall not be infringed. Any restriction on this right shall be subject to strict scrutiny.

The problem with this is that the first sentence contradicts the second sentence. The first sentence states that the right shall not be infringed. The second states that any restriction is allowed. For a right not to be infringed there can be NO restrictions whatsoever. The word restriction does not belong in this bill at all!! The way we have it now, we can carry all we want as long as it is not concealed. The ONLY restrictions in place now are on concealed carry permits.


What I meant was, to urge the legislatures to vote no.

I will be voting "YES" when the time comes! Not sure how you are reading it, but the bill was authoured to insure the 2nd Amendment rights could never be questioned to a legal Louisiana resident. It is backed by the NRA as I understand it.

Wait, I don't think we will be voting on it at all. It's up to the legislature to pass it so you have to have the votes in the house.

Unless Constituttional amendment, we will not vote on it. Will have to go through the legislature. BUT, they are not in session now.

The second sentence opens the door for restrictions. So they will be scrutinized by the court. Big deal.

You are correct. It is a Constitutional amendment.

Riser (SB 303) Act No. 874
Present constitution grants a right to each citizen to keep and bear arms and provides that this right shall not be abridged and provides that this right does not prevent the passage of laws to prohibit the carrying of weapons concealed on the person.

Proposed constitutional amendment provides that the right of each citizen to keep and bear arms is fundamental and shall not be infringed.

Proposed constitutional amendment further provides that any restriction of this right be subject to a standard of strict scrutiny by a court in determining its constitutionality.

Proposed constitutional amendment deletes the provision regarding the passage of laws with respect to concealed weapons.

Specifies submission of the amendment to the voters at the statewide election to be held on November 6, 2012.
(Amends Const. Art. I, §11)
