Default affidavit of non use

We have two vehicles and only use one for towing a boat. I sold the boat and just let it sit there. Well I didnt wanna pay insurance on q vehicle that just sits there so I didnt. Well me being new to LA, I didnt know I had to keep insurance on it. So now I have a nice big fine to pay. Is there anyway I can affidavit saying I wasnt driving it or are those only good for before ypu cancel it? Any help is appreciated....

You have to turn in the license plate anytime you don't have insurance on a vehicle. I think you can do the affidavit tho, but it's only for so long

Even if you drop insurance before turning the plate in, you get a fine. Not sure on the affidavit, but they are strict

How??? It's estimated that 40% of Louisiana drivers either have no insurance or min limits. This costs all of us who carry insurance more because we pay for those claims with higher premiums, same thing O-Care is doing. Pi$$e$ me off when I see them Installing the fluorescent sticker just to let them drive away for a month without insurance. If I get hit, that will be challenged in court because I plan to sue the agency who let them walk without insurance.

About 7 years ago my wife was hit head on by a guy that had no insurance and driver license I had fork out the money for all the repairs oh and he didn't have a job they gave him a ticket that's it that what pis$$e$ me off.

I had a buddy about 7 years ago who is a farmer, he had a guy run into his truck "parked" on side of a road..

The guy had a job but no issuance and had some kind of excuse that the truck was a hunting truck and only took it out on road to get oil changed that day!



He sued the guy and got 100% of the repairs paid.. but once the guy got the suit he volunteered to pay for the repairs and cost of attorney fees to drop the suit

So ge did,

This was at least a good out come

If you have a vehicle that you don't drive or only very seldom take it out......there is a much lower Insurance rate that you can get and the vehicle is covered.

I did this 20 yeas ago after I got a company truck.

Fine now starts the first day without insurance and is $25 per day no max.

Beware! Your insurance company is required by law to notify the state that your insurance has lapsed / been canceled. But even if you get more insurance or turn in the plate before the lapse or on same day .The insurance company is NOT required to notify the state. So, all the state knows is you have no insurance and they flag your license. So if you get stopped or try to renew your license you will need to show where you picked up insurance or turned in plate on same day or before the lapse.

Louisiana Notary Here,

On a vehicle you do not have insurance on with a regular plate (not specialty) you have to cancel the plate concurrent w ith the insurance. however if you have a specialty plate you may inactivate it with a NON USE affidavit but you have to go to the DMV office and file the inactivation and then when you decide to reactivate the plate, you must go back to DMV with proof of insurance and reactivate. I have a Ham Plate (Amateur Radio) and it travels with me, not the truck so specialty plates are treated a little different.

Cajuncoin - you are almost correct. No matter what type of plate you have, it must be canceled. You can have a regular plate, and choose to keep it, just as a personal plate, or HAM plate, or CCA plate, or DU plate. It is not the plate that matters - it is the fact the state is going to get notified of NI status. And the registered owner of that plate will get the flag, no matter who is currently operating that vehicle.

And depending on the situation, I don't always tow an uninsured vehicle. I will sometimes pull the plate and issue a seperate citation for NI, which is another $70. If it is a repeat offender, it goes on tow truck!

Another thing, with the current law, the driver is required to "show proof" of insurance. (And this Pesssesssss me off to no end). If the driver has a cert showing the insurance is good for another 5 months, but the computer is showing it is NI, I can't cite him/her. Even though it is a pay on-line POS insurance company that allows them to pay monthly. So they can get insurance, and stop paying premium, but still ride until that old card is no good.

It is only terminology (inactivate=cancel active registration), the fact remains specialty gets a different treatment at DMV, now you being law enforcement, the terminology and policy get mixed signals. You still can not leave a canceled or INACTIVATED plate no a vehicle. Most People have a bad habit of letting the plate go with the vehicle thus starts the problem.
