Picture isn't very clear. What do the leaves look like? I apologize if that is what the second picture is. Its not loading on my phone.

yes the second picture is a close up of the leaves. But they are flat, medium sized leaves and some turned red. The tree also has acorn shaped seeds on it, I don't know if there seeds are flowers I haven't seen any yet. I was hoping it was just a bush that hadn't been pruned .Lol

Looks like a shrub, possibly a Rhododendron. Its not an oak, judging by those leaf arrangements.

Does it get little white flowers on it? Or any flowers at all? It looks like a sweet olive to me.

Dig it up and plant something else. It's too close to your house anyways.

Not a sweet olive. Its a Japanese Blueberry. Definately too close to the house. Ive seen those get 30' + before. Big roots too.

looks like wax myrtle to me. but im not a tree guru by any means. just looks like the same stuff we brush blinds with

I dont know them all, but I know that one!!! Lil fruits look like nutria turds all over the ground. lol

If you can get enough root out with it, you could probably save it. Gonna need a big bed or plant out in the yard somewhere.
