you can refuse a search of your vehicle, if they search anyway you can sue them for violating your civil rights, unless they have reasonable cause to believe you have drugs, or stolen goods etc (which they would have to prove). BUT an officer can search your "person" for weapons for his safety, which isn't a violation of your civil rights, because the officer is in "color of law".

I don't believe Ironman's vehicle was searched, he probably had his "person" searched for weapons for officer's safety, which entitled the officer asking him if he had any weapons on him and asking him to either empty his pockets or being pat down.

F_ing cops, my car got towed today while i was at CVS because of some unpaid parking tickets...$300 worth of parking tickets turned into $900 worth of parking tickets and fines

yes, my persons was searched not my truck. my pistol was in my leather holser with both mags inside the center console and my pistol sitting on top unloaded and snapped in. i really didnt care about the search. I know how cops work and someday I will hopefully become one. it was the conversation after he saw my Marines sticker on my back glass and then I learned he was ex army. I'm a bit of a smart ***, but I'm not stupid. I bought my gun a month ago from a private party (you gotta be 18) and the only time I carry it loaded is when I'm fishing, driving through the bad part(s) of New Orleans and Baton Rouge, or when I'm shooting it at the range or working in the woods. I like all branches of the military and support them. I hold no grudges towards the Army, Air Force, Navy or Coast Guard as I have people close to me in all branches.

So Baton Rouge is in a fight w/ New Orleans on who will be the leader in the number of murders in the state of LA. So, you are driving and made an 'erratic' move by turning "at the last minute" w/ no signal. As a former law enforcement officer, I would have pulled you over just like him.
Approaching a vehicle with a subject in the truck, which has a handgun in plane view, I would have done the exact same thing. What was going through his head? Were you a felon? Were you impaired by drugs or alcohol? Are you a mental case riding around w/ a gun on in plane view? Hope this helps you understand why you are not getting a bunch of sympathy here! And to be even more candid, had you been a "smarta**" with me, your warning would have been a small sheet of paper with a citation number on it. I carry multiple weapons and none are in "plain view". Yours should not be either, mainly because they lead to theft of said firearms from criminals!!! Use your head young man. As far as Dink saying not to allow a search. If you have something to hide in the vehicle, that is a sure way to get it located by law enforcement. I had numerous encounters when I was working the roads by people just like him that thought they were "roadside lawyers". Fact of the matter was, I always had the last laugh. They would yank my chain and not allow me to search the vehicle if we had a reason to think something was inside. Most of the time it was people we were "familiar" with from drug deals. They would refuse, I would detain the vehicle until I got a search warrant. They would get more anal, I would laugh. They would preach about their "rights" and I would confirm those rights and tell them they were free to leave. At that point in the conversation they would get a smirk on their face and think they "won". That was until I told them they were free to leave - WITHOUT their vehicle. See, you as a human have rights, but the vehicle has none. I can hold that car there until that warrant got there, but you were free to walk wherever you wanted. So in the end, they realized that either way, they lose. Funny thing is, when I woke a judge up in the middle of the night to get a warrant, and found nothing, the judge always seemed to find out that the driver was jerking my chain. At that point, it now ticks off the judge and it's like they have a special little note book that keeps those names fresh in their mind. Guess you eventually has to see the judge, sometimes years later - yep, you guessed it! The jerk that tried jerking my chain! As they say "Karma is a *****". I know lots of guys on here are anti law enforcement/pro mary-jane, because we have had that topic before. The fact of the matter is, these men & women that people bash for being on a "power trip" are the same ones that will be the first to arrive when your wife or child is in need of someone to save them. Sometimes we need to think about what it is like to live your life, wondering if today is the day you get shot and your wife becomes a widow. |

Thanks Fin! My brother is a cop. I worry about his safety all the time. People are unpredictable, PERIOD! I want him to make sure that he get home to see his kids at night and if that means making someone else uncomfortable, so let it be done! People complain about em but, as with one of our members, those guys may have saved he and his wife's lives! They have a job to do. Some are better at it than others but, at the end of the day, their jobs still have to get done and that job is your and their safety!

I agree with a lot of what Bryan stated above, obviously there are far too many variables/emotions that come into play to be able to define what is acceptable behavior on both sides of the fence here. There are outlaws who will push the limit just like there are a few bad LEOs that give the good guys a bad name.

I think this thread has run its course. Leave it be. I was totally compliant with the officer and my pistol was only on top of my center console because I was going to Precision. Any other time, it is inside my center console out of sight and unloaded or loaded depending on the city I'm traveling through. Right now, I'm trying to leave for boot camp and I'm trying my hardest not to screw that up. But I am aware that cops are looking out for their safety as well as the person they have stopped and others. I really hold no grudges against any cop unless he/she makes up a charge. I'm planning on being a cop in Gonzales once I hit 21. But as far as this post has gone, just leave it be.
