The author of that post is very misinformed about the current constitutional provision, the proposed provision, and generally on constitutional law. Unfortunately, his misunderstanding does a better job of hurting Second Amendment rights than any anti-gun group or individual in Louisiana.

This link above is without author bias, agenda or personal belief. It reads "This proposed constitutional amendment, if adopted, will rewrite the existing provision and, instead, provide that the right to keep and bear arms is a fundamental right which shall not be infringed. It will also provide that any restriction on this right shall be subject to "strict scrutiny", which is the highest standard of review by a court. The "strict scrutiny" test requires that a state have a compelling governmental interest necessitating the infringement and that there is no less restrictive method of accomplishing the compelling state interest." My bias in this matter is The statement reading "any restriction will be subject to Strict Scrutiny" is subjective and opens up doors that are not there now. If it is a fundamental right and cannot be infringed then there is no need for a review of any restriction. This amendment needs more work and I say this is opening up loopholes and more subjective interpretation that is unnecessary. This amendment is not ready and needs adjustment and therefore a no vote |

I would encourage everyone to read the following information before voting tomorrow. The above misinformed posters would also benefit from more information.

The proposed amendment is historical because it will be the first time a state will recognize the right to keep and bear arms as fundamental and provide the highest legal protections -- strict scrutiny. Strict scrutiny requires state courts to respect the fundamental right to keep and bear arms when reviewing any statute. The current right to keep and bear arms amendment in the state constitution has been rendered meaningless by the Louisiana courts because they assigned it the lowest level of judicial review (rational basis) -- virtually any future gun control legislation would be deemed constitutional under this level of review. The proposed amendment requires the highest level (strict scrutiny) -- if passed, it would be the first time Louisiana protects the right to keep and bear arms on the same level as your right to free speech and right to vote. Additionally, the proposed amendment removes the legislature's constitutional authority to ban concealed carry. The removal of this provision will protect law-abiding Louisianan's right to carry. Do we want law enforcement to come in our home and conferscate all gun's ? Its'our own fault for not following up in state legeslative proposed ammendments.Ivoted yes because even it isn't politcally correct a yes vote will still give us the right to bear arms.
