After insurance company totals boat and motor you will be responsible for deductibles so I doubt you will be ahead. I would get your trailer to a frame shop to check it out and claim it also if it is even slightly bent. Your only advantage is it's new so if your coverage isn't agreed value they will not depreciate which gets you close to whole. You will not be able to get a judgement against third party if insurance pays you, it will be their job to recoup their money and I doubt it will happen. Anyone caught driving without insurance should have auto impounded and pay a fine and have purchase insurance annually without out the ability to cancel. Second offense, impound auto and sell at auction with proceeds put into an uninsured motorist fund to compensate drivers and insurance companies for claims.
