Ok, guys, I need some help. There has to be at least one lawyer on here. I gave a Texas hunting outfitter over in Tom Green county an $1800 deposit for 6 hunters back in October. The hunt was supposed to take place the 2nd weekend in January. Well the rancher called me 1 week prior to the hunt to cancel on me due to the fact that the deer were not showing up and that his aunt died and he had to help with family business. Fine, not a problem. I would rather an honest outfitter over a dishonest one. He could have let the guys go hunting and say that it was some other reason for no deer.

Here's the situation. I have yet to get my deposit back. He has told me on several occassions over the past month and a half that he will get it to me "next week". Now he won't return phone calls or email.

Question is: Can I sue him in Calcasieu Parish or do I have to file suit in Tom Green County?

i would simply ask him if he wants you to get your lawyer involved, usally that is all you need to say. i would avoid actually hiring a lawyer because it can be a costly and timley path to go down.

Not an attorney but I would sue in TG county. It is going to cost you 3x the $1,800 though for court. If you got the $$,I would atleast get a judgement against him. Works just like having a bankruptcy on your credik.

Told him in several emails that I would give him til wednesday 3/16 then I will call the DAs office in his county and TPWD officials. NO reply still!

just show up at his place im sure he has 1800.00 worth of stuf youd love to have that aint bolted down! when someone messes with my $$$ all rules go out the window i will ruin someone over 5$ if they piss me off bad enough ....general principal

I thought about that but it is a 9 hour drive and his place is behind a locked gate on a high fence ranch. He just built a 350,000 home on 80 acres just south of San Angelo. Besides, gas it pretty high ya know!

yep . just call that fool everyday, email him everyday , . people always owe me $ for house s i build or work on ect... i just stay persistant and make it known IM NOT GOIN AWAY TILL YOU PAY ME

In louisianna you can Sue for damages plus court costs(which they only pay if they loose). Not sure about Texas, but to answer your question, yes you have to Sue him there, not here

Sounds like an open/shut case if you have a receipt for the deposit. Small claims court if you have the time, no lawyer needed.

Yeah nuttin to it for small claims. You will have to file suit over there. But here in Calcasieu court costs were only 175 dollars and since I won the case the other party has to pay that plus judicial interest! No big expense and no need for a lawyer.

I always like the "lien" tactic! It's amazing how many things get paid when you put a "lien" on them. Dang, we get paid to go shut in wells from people not getting paid from some of the smaller oil/gas companies. It's amazing how fast we get called to go back and un-padlock the well head! LMAO!

How embarressed would the guy be at the car dealership when he can't finance his new Kang Ranch because of a judgement for $1,800 + intrest??:D

When people say "go ahead, sue me"! That is exactly what I think of!!!!!!! Sitting there with the wife in the dealership getting a new ride, then the old "I'm sorry sir, there seems to be a problem" speech. Then after they say you have a lien, he goes "***", then it hits him............like a sucker punch in a dark bar.......the guy you tried to screw 18 months ago!:*****::*****::*****:
