If you cannot see the bird clearly enough to identify it as a gobbler (and, in many areas, a mature gobbler) you have no business being in the woods with a loaded gun. There is absolutely no excuse for accidentally shooting someone.
Unless, of course, the dude was doin' figure 8's around his blind.
