Hairout Fuming Mad!!! - But need assistance!!

I need some assistance/guidance from anyone in the healthcare industry. I have gone to 1/2 dozen websites and don't have the time or law degree required to find what I need.

Under the new Affordable Health Care Act (Obama Care) if a part time employee works 30 hours a week, they must be provided health care insurance by the employer (or offered). Fine! We get that!!!!

Problem is, I need to find a waiver or some other document in writing which shows that if a part time employee has coverage from his full time job, then the part time employer can not be fined for the employee not taking his/her insurance.

I would go into more details, but it would just make everyone so steaming mad on this website that we would increase the bandwidth for a rant session!

This only applies if there are 50 or more eligible employees. Is that the case in this situation?

Yes - well over 50.

It comes down to full time employees with full health care coverage, working as part time police and fire fighters. City is afraid they will be fined if part time guys/gals work more than 30 hours aweek. Crazy!!!! I know!!!!

I'm no attorney; but I would suggest that instead of a waiver you need to have these employees refuse coverage, in writing of course!

That way you accomplish 2 things, it shows that you offered the employee "affordable" insurance and they declined.

To the employer it doesn't matter if the employee has insurance somewhere else or not. It matters that the employer proves that "affordable" insurance is offered to eligible employees.

Brian, proof of coverage at full time job should fulfill the requirement at pt job.

I agree with both of you and should be pretty easy. But I have to find it in writing to make my case.

I have 2 that make 6 figures a year, both home 14 days a month and bust their arses to make the community better. Both put their life on the line, but now we have to insure they don't get more than 29 hours a week. I rarely work more than that, but just recently we had an incident where it was "all hands on deck" for days. We are not flipping burgers, we are not washing cars part time - we are out there fighting fires and chasing bad guys. This is just crazy!!!
