Please correct me if I'm wrong but if there are not any "no trespassing or private property" signs, markers, fences, etc. on a public waterway then even if you are caught supposedly trespassing it is not enforceable in a court of law. If a landowner is not doing his due diligence to build a levy or post it properly, it is assumed public waterways.

Yeah good luck with that. There is no longer a requirement in Louisiana for landowners to post signs. It is definitely enforceable. |

On land yes but good luck getting it to hold up on water.

![]() http://ri.search.yahoo.com/_ylt=AwrS...ZNo_nOwFYVl9I- There are numerous cases and a few articles that explain it pretty good, but I have received criminal trespassing charges for tying up to a pump station on Toledo Bend and accessing marsh east of Fourchon, LA. I assumed navigable waters where any waters in which your vessel would float and you could transit... I was way off. |

The real definition of navigable waters has something to do with waterways defined as used for commerce. And that's based on old outdated charts and maps. Not just if you can float a boat in it. But I'm sure we all agree that its time for laws to be updated in Louisiana. |
