Default Buying Used in Texas...Questions

I have made a deal for a bay boat in Texas. I have a couple of questions.

1. I am buying from an individual, will I have to pay taxes in LA? Do I need any documentation to show the sales taxes were already paid?

2. Texas does not require a title for boat trailers. The owner does not have a title for the trailer but he does have the trailer registered. What will Louisiana require from me to get the trailer registered in my name?

You will pay sales taxes in la.

You must have a title to present to dmv. Bill of sale and, registration will not likely be enough.

I thought I wouldn't have to pay sales tax if I purchased from an individual?

I had to pay sales taxes on a truck I already owned when I transferred it to la! Maybe things have changed but, I doubt they've lowered any taxes.

If the boat you are buying has valid current Texas boat reg., you will not pay on the boat you will have to pay on the trailer. When u put a bill of sale together get the guy to break down your purchase showing as least as possible for boat trailer and that can be taken care of at MV. And as far as the boat and motor you will need to go to LDWF in Baton Rouge and u should only be charged a transfer fee, make sure his reg. on the boat and motor or current and verify with LDWF what paperwork is needed to transfer.

Just seen that in your post where u said trailer does not have title, that would be a deal killer for me, every boat trailer ever made has a title unless homemade no matter what state it is purchased in. MV can not and will not reg. that trailer without a title even if he has Texas plates it does not matter that title will be needed. Good Luck

I went thru this recently. You have to pay state and parish taxes on the boat. Just state on the trailer. Texas trailers do have a title. Go to wildlife & fisheries to get the forms and instructions on the proceedures. If I could do it all over I would not buy an out of state boat. Yes I got a great deal but after all the transfer fees, taxes and hassel I didnt save much.

That is about what I am thinking. Hell, when my dad gave me a small flat boat I ended up having to buy a new trailer for because S.C. didn't require him to Title the trailer and he didn't have the certificate of origin.

The seller tells me he does not have the title to the trailer and that one is not required in Texas. If LA requires that he have one to get it in my name I guess our deal is going to be off because I am not going through the same crap I went through with my dad's little flat boat.

I am tempted to just go buy a freakin new here in LA and be done with it.

I bought several from Texas (used from individuals). Never had to pay sales tax on boat from individual only had to pay tax on listed price of trailer. As long as boat was registered in Texas then you can transfer over to La, you may have to surrender title on boat and motor over to La DWLF. Will have to go to parish and state tax office and get a stamp saying "No taxes owed" since bought from individual. Should not have problem with trailer, just do separate bill of sale for it. Call title company just to be sure- they are much easier to deal with than DMV.

i bought a boat last year from florida, no taxes on the boat, only the trailer. The taxes on a used boat bought from and individual are waived by state and local tax. its on the dept of revenue website also.

On the top of my trailer registration in Texas it says "Untitled Trailer Registration". I bought it from a dealer that way and sold it to an individual that way. I don't know how that translates to LA, I have bought boats from there and brought them to Texas.

Chris,

If I pull the trigger, I will be buying a 2008 Tidewater 2100 with a 150 Honda on the back. Boat comes with GPS, Lowrance depth finder, trolling motor, hydraulic jack plate, bimini top, cover and dual axle trailer. The boat won't be a screamer with the 150 on the back, but I suspect, and hope, that it will be dependable. Of course, just when I found this boat I found another that I had been looking for for several months.

That's a nice boat; he Honda 150 is a reliable engine for sure.
Sounds like a nice set up.

My advice; once u buy this boat or any boat.... Stop looking at other boats. Period; lol
You will most likely see another boat u like or a better deal; I sure did. And it took away a little of the enjoyment I had buying mine.

I have a title for my Texas registered trailer. I had to present it to get my trailer tags. I'd make sure the guy is being straight with you on this point.

I'm in the same positions as you. I called the wildlife and fisheries and you need to get a Boat Registration Tax form. Fill it out then go to your nearest tax assesor office and pay taxes on your boat. they will stamp the form and sign it. then fallow the same step at the parish office also. Finally send that paper work with all the title, registration and notary paper work to the wildlife and fisheries in order to get the titile in your name... jeez its a lot of mess!!!
